General Terms and Conditions (GTC) of École Suisse de Ski et de Snowboard Rougemont Sàrl
1. Scope of application
These General Terms and Conditions (“GTC”) apply to all services provided by École Suisse de Ski et de Snowboard Rougemont Sàrl (the “Organizer”). They govern the relationship between the Organizer and any person (the “Participant”) who books or participates in activities.
2. Registration and conclusion of contract
2.1 Registration
Registration may be made online, by email, telephone or in person with the Organizer or an authorized partner. Availability is limited and cannot be guaranteed. Early booking is recommended.
2.2 Conclusion of Contract
A binding contract is concluded upon confirmation of the booking.
By registering, the Participant accepts these GTC as an integral part of the contract.
2.3 Participant Responsibility
The Participant is responsible for providing accurate personal information and checking all booking details.
Any errors must be reported immediately.
Any costs resulting from incorrect or incomplete information shall be borne by the Participant.
2.4 Snowsports Lessons
Group lessons for beginners generally start on Mondays.
Advanced participants may join ongoing groups during the week, subject to availability.
Registration deadline is the day before the lesson starts. Same-day registration is subject to availability.
Private lessons may be booked in advance or on the same day, subject to instructor availability.
2.5 Outdoor Activities
Participants are advised to book at least three (3) days in advance.
Short-notice bookings may be accepted depending on availability.
The availability of guides cannot be guaranteed.
3. Services
The Organizer undertakes to provide the booked activity as described at the time of booking.
The Participant undertakes to pay the agreed price.
Additional services will be charged separately.
4. Prices
All prices are stated in Swiss Francs (CHF) and include applicable taxes.
Prices may be changed at any time.
Prices in foreign currencies are indicative only and non-binding.
5. Payment
The total amount is due before the start of the activity.
If payment is not made on time, the Organizer may refuse participation or cancel the booking.
6. Cancellation by the Participant
6.1 General

Free cancellation up to 24 hours before the activity

Less than 24 hours: 100% of the price will be charged
No refunds will be granted in case of:

Late arrival
-
No-show
-
Early departure
6.2 Snowsports Lessons

Group lessons: free cancellation until 17:00 the day before

Private lessons: free cancellation up to 24 hours before

Private lessons with a specific instructor: free cancellation up to 14 days before
After these deadlines, the full amount will be charged.
6.3 Third-Party Services
If services from third parties are booked, their cancellation conditions apply.
6.4 Cancellation Insurance
Participants are responsible for arranging their own cancellation insurance.
7. Changes or Cancellation by the Organizer
The Organizer may cancel or modify activities due to:

Weather or snow conditions

Safety reasons
-
Events beyond our control
-
Lift closures or operational issues
-
Insufficient number of participants
The Organizer may offer an alternative activity, issue a voucher, or provide a refund.
Further claims are excluded.
7.1 Minimum Participants
If the minimum number of participants is not reached, groups may be combined or activities cancelled.
If no suitable alternative is available, payments already made will be refunded.
7.2 Behaviour and Fitness
Participants may be excluded if they do not follow instructions, endanger the activity, or are unfit.
No refund will be granted.
7.3 Program Changes
Meeting points, schedules and activities may be adjusted.
If a significant change occurs or the price increases by more than 10%, the Participant may withdraw and receive a refund.
7.4 Snowsports Lessons
Groups may be reorganized, shortened, or rescheduled.
Partial refunds may be granted where appropriate.
8. Participation Requirements
8.1 Health
Participants must be in good physical and mental condition.
Participation under the influence of alcohol or drugs is not permitted.
8.2 Instructions
Participants must follow all instructions.
Failure to comply may result in exclusion without refund.
8.3 Age
Participants under 18 require consent from a legal guardian.
Minimum age requirements apply.
9. Special Provisions – ATV Tours
9.1 Requirements

Minimum age: 18 years

Valid driving licence (Category B)

Suitable clothing and footwear
9.2 Rules
Participants must follow the guide, remain on designated routes and not overtake.
Alcohol and drugs are strictly prohibited (0.00‰ tolerance).
Violation results in exclusion without refund.
9.3 Liability and Insurance
Participants are fully liable for:

Damage to the vehicle

Damage to third parties
-
Fines or legal violations
Insurance includes a CHF 1,500 deductible payable by the Participant.
Accident insurance is not included.
Participation is at the Participant’s own risk.
10. Insurance
The Organizer does not provide personal insurance.
Participants must arrange adequate insurance, including health, accident, liability and cancellation insurance.
11. Liability
The Organizer is liable only for damages caused by intent or gross negligence.
Liability for slight negligence is excluded to the extent permitted by law.
The Organizer is not liable for:

Inherent risks of activities

Actions of participants or third parties

Events beyond our control

Failure to follow instructions
12. Complaints
Complaints must be reported immediately to the instructor or guide.
They will attempt to resolve the issue on site but cannot acknowledge liability.
13. Data Protection
Personal data is processed in accordance with Swiss data protection law (FADP) and, where applicable, GDPR.

14. Applicable Law and Jurisdiction
Swiss law applies exclusively.
The place of jurisdiction is the registered office of the Organizer.
15. Assumption of Risk
Participation in activities involves inherent risks, including injury or accidents.
By booking, the Participant acknowledges and accepts these risks and agrees to follow all instructions.
16. Final Provisions
If any provision is invalid, the remaining provisions remain unaffected.
The Organizer may amend these GTC at any time. The version valid at the time of booking applies.
17. Governing Language
These GTC are drawn up in English and may be translated.
In case of discrepancies, the English version shall prevail.
